How does the mediation process work in employment disputes, what should I expect?
You can expect a more informal setting compared to traditional legal proceedings. A neutral mediator will guide you and the other party through discussions. This person doesn’t make decisions but helps you communicate and find a mutually agreeable solution. In my experience, this process works quite well, and employment mediation is a lot faster than going to court.
Throughout the process, you’ll both get the chance to express your concerns. The mediator will encourage open dialogue, aiming to help you understand each other’s positions better. You should feel free to discuss any issues that matter to you. Remember, the goal is to find common ground and negotiate a solution that works for both sides.
During mediation, you can expect confidentiality to be a key component. This means the discussions won’t be used against you in future legal proceedings. It creates a safe space for honest communication. The discussion is also not legally binding, so speak freely and try different ideas. Once both parties reach an agreement, then you sign a binding document with the terms of the agreement.
